lie strong. why are we talking about it? >> everybody's talking about it. they say in an interview with oprah winfrey he admits for the first time he used performance-enhancing drugs while racking up win after win on the cycling tour. let that sink in for a moment because for years armstrong not only denied using the drugs and meth audios but he viciously attacked everyone who said he did. now that appears to be a giant sham. sources say he's in talks to return sponsorship money and may be ready to testify against others. cnn's ed lavandera is live in austin, texas. ed, what do we know about this confession? >> i think the million-dollar question is to what extent lance armstrong apologizes and what will that sound like? will he apologize or admit to

using steroids throughout all of his cycling career? i mean to what level will this be done? more importantly, just how he will say it. not many details other than beyond that headline, that according to media reports lance armstrong will admit to using steroids in his interview with oprah winfrey. not much coming from oprah winfrey as well. shortly after wrapping up the interview here in austin, texas, oprah sent out a brief tweet. just wrapped with lance armstrong more than 2 1/2 hours and he came ready. she wrote "ready" in all caps. if past interviews are any indication, lance armstrong, you knowing has over the years, john, been a very tough interview, very steadfast, so it will be very interesting to see how his tone and attitude changes now if he has to be a

lot more forthright and contrite. we'll see how that plays over. >> he is a proin these intervie interviewses. the question is after all these years of denials and, frankly, vicious attacks of people accusing him of doping, why might he confess now? what might he get out of this? >> i think there are several different things out there. to what extent each played a role will be answered in the interview. as you mentioned right off the top, the post, "lie strong" instead of livestrong. he went to the headquarters of the livestrong headquarters and apologized to the staff there for the stress he had put them all under, so the livestrong aspect of this and wanting to make sure that agency is able to continue doing the work it's done over the years plays a role. but also lance armstrong, since he's given up cycling has been

competing in other events p. perhaps he's looking to get his sentence lessened and compete and make money that way. a lot of different aspects playing into the role, we expect. >> what about the potential legal aspect from admitting he was lying all those years? >> you know, it's interesting to me. there are still several things out there that lance is having to deal with. there's a special federal whistle blower lawsuit brought by a teammate floyd landis and a cnn source confirms lance armstrong is in talks with the u.s. postal service which had paid a reported $30 million over the years to sponsor lance armstrong's cycling team and we understand there are talks under way now for lance armstrong to return a portion of that money as well. remember, there was a deposition from dallas-based insurance company that had paid lance

armstrong bonus money for winning back-to-back wins. lance armstrong speaking with that company's attorneys. listen to what he said when he was asked if he had taken any steroids. >> you have never taken any performance-enhancing drug in connection with your cycling career. >> correct. >> and that would include any substance that's ever been banned, is that fair to say? >> correct. >> john, all of that was under oath, but that was back in 2005, and the statute of limitations for perjury here in the state of texas is three years. so at least in that particular case, it doesn't seem that lance armstrong would face any legal troubles, and you would imagine that with a team of lawyers that lance armstrong has, the timing of this interview, they must have felt pretty secure from a legal standpoint that lance armstrong could come out and make this confession. but to what extent and how

deeply he goes it into will be interesting to watch. john. >> perhaps no criminal lie biblt but still faces maybe civil damages as time goes by. it's the end of years'-long. >> there's a cancer doctor that has treated him says he's still a hero. he beat cancer and remains loyal. even if he doesn't have a lot of company he's still a hero because of his will and he beat cancer. >> you can be a hero when it comes to beating cancer but he's still a li liar. i hope it does not affect the foundation. >> in six hours new york state may become the fifth state. last night the state senate set a set of broad changes.

expanding the ban on assault weapons. his plan heads to the state assembly later this morning. >> this is a scourge on society. people have had to live through these tragedies. tragedy after tragedy and tragedy, and people are sitting there saying, you know, at what point do we get it? at what point do you say enough? we understand. no one else has to die. no more innocent loss of life. >> cuomo's bill also includes a webster provision, a life-without-parole provision for anyone who murders a first responder. that's in response to the fire and ambush shooting on christmas eve that killed two first respond responders. the vice president reportedly recommends background checks on all gun sales making

certain rapid-fire guns off limits and keeping guns away from the mentally ill. president obama is expected to formally lay auto these measures later this week. on the former fiscal cliff, president obama is digging in his heels. he said he would not trade cuts in government spending which they want. he said trimming the budget deficit should be a different discussion separate from the debt ceiling. >> raising the debt ceiling does not authorize us to spend more. all it does is say that america will pay its bills, and we are not a deadbeat nation. >> clearly house speaker john boehner thinks differently. he responded by saying, quote, the american people do not support raising the debt ceiling without reducing government

here's why, zoraida. what we've got is the stalled front and along the front we've got everything from rain, sleet, even freezing rain that will become a snow maker. what's happening in the pink, what we're seeing is rain is famming. it's falling below freezing, thus we're getting icy surfaces on the road. we could see ice accumulation and a quarter inch of ice. we'll see power lines go out, winds begin to sag. roads get icy. you can see some of that's falling now. and also the potential for flooding already had one to two inches of rain along this line and it's really not moving much. washington, points south, you can see where that rain is falling. it's going to fall over the same areas, and we're going to watch that rain move into washington, d.c., as well. it's already there now. with that, the flood threat throughout much of the east. and, again, winter weather advisories. where we've got the rain. and we'll see it for the next two days. right here you can see south of

president obama to try to stop these horrific shootings, making certain rapid-fire weapons off limits and keeping guns away from the mentally ill as well. white house correspondent dan lothian is following all of the developments for us this morning. very nice to have you, dan. >> reporter: good morning. >> we know the vice president has sent forth his recommendations. we don't have a copy but you know some of the de-dales in it. could you share with us? >> reporter: that's right interesting that the vice president said today would be the day he would recommend the proposals to the president. he met with the president yesterday and both of them starting reviewing some of the recommendations, the president pointing out that later in the week he'll talk in more detail about what his administration plans to do going forward. some of it will require congressional approval. other things the president plans to do on his own such as a registry, the president said, or getting more data in tracking

the weapons that are used by criminals. the president yesterday during his news conference gave a hint as to what the proposals will look like. take a listen. >> what you can count on is the things that i have said in the past, the belief that we have to have stronger background checks, that we can do a much better job in terms of keeping these magazine clips with high capacity out of the hands of folks who shouldn't have them, an assaults weapon ban that is meaningful, that those are things i continue to believe makes sense. >> reporter: now, the president says he's not worried about politics but he's focused what makes sense, what works, and what is best to keep america and children safe. >> last night new york state lawmakers came to a deal on new gun restrictions. it has buy part san support. tell us about that. >> that right. it goes on to the state

assembly. part of this bill will focus on assault weapons, creating an assaults weapons registry, also a uniform licensing system state wide. i'll tell you. new york is not the only state. a number of states are looking at ways to prevent gun violence. maryland is one. some of these local and state leaders are in maryland meeting at a gun violence summit there, looking at ways to prevent gun violence. and governor cuomo talked about the need to really do something to keep kids safe. take a listen. >> this is a scourge on society. people have had to live through these tragedies. tragedy after tragedy after tragedy. and people are sitting there saying, you know, at one point -- at what point do we get it? at what point do you say enough? we understand, no one else has to die?

no more innocent loss of life? >> the nra, though, is vowing to fight any restrictions on guns. they don't believe that an assault weapons ban will be able to make it through congress, but nonetheless, the public out there seemingly on the side of what some of these lawmakers are pushing. an abc washington news/washington post poll say 58% support it, 39% oppose it. 51% support a ban on semi-automatic handgun, 46% oppose. on high-capacity clips, 65% support it. 32% oppose it. a lot of things they're trying to deal with. >> dan lothian at the white house. thank you very much. about 18 minutes past the hour. right now let's get you updated on all the news this morning.

after denial, lance armstrong has reportedly admitted to using performance-enhancing drugs. the interview will be broadcast on oprah's tv network on thursday. >> more controversy for troubled actress lindsay lohan. the 26-year-old is expected to be arraigned on charges of a car crash from last june when she was already on probation. she fired her long-time l.a. attorney who has managed somehow to keep her out of jail so many times. retail market walmart rolling out the red carpet for the military veterans. the company will announce a plan to provide a job to any service meb who's received an honorable discharge within the past year. the new hiring program will begin on memorial day, may 27, and last five years. that's a nice program.

it's time for your early reads, your local news that is making national headlines. first from the southeast mercury news which has the pulse on silicon valley. could it be the face phone? we're speculating. facebook is inviting the media to an event today, to, quote, come see what we're building. there's speculation the network could be unveiling its own facephone. some think it could be a new sch engine and tap into friends' suggestions and take on rev snu. >> they're looking for a way to make revenue. we'll see if it works. >> monetizing would be greats news for them. supreme court justice clarence thomas has been silent, famously sew, during oral arguments for nearly seven years. that is a record. well, it seems that justice thomas finally broke his silence yesterday.

we're minding your business this morning. u.s. stock futures are trading lower. >> shares of apple fell sharply while dell stocks surged. alison kosik is in. >> it doesn't usually work that way. you know why it's happened? it's amazing how much investors will react to a report. a report came out of bloomberg saying dell was considering being bought out, going private. what you saw was investors react immediately. you saw stock jumped. dell is up 2.5%. you saw the stocks spike to its highest level in five months. dell has had a rough time of it. shares have dropped 30% in the past year. it's fallen far from the heyday of the 1990s when "dude, you're

getting a dell," the commercial we all saw. michael dell created the dell in his dorm room at 19 years old in austin. it was huge. it is huge. it became the world's biggest pc maker and lost that title in 2006 to hewlett-packard. what it does is builds these to-order customized pcs. the problem is dell fell behind. it didn't evolve into the new world of smartphones and gadgets. when's the last time you bought a p.c.? >> what's a p.c.? >> and you said -- you were thinking about buying one. >> only for my son because he's headed to high school and you asked me which one. it's a mack. >> that's the problem. dell hasn't evolved. what's it going to do? why not go private at this point. even the world is saying dell is in talks with at least two private equity firms. this whole thing could fall

apart. these are just reports. some analysts are saying, good luck with this deal because it's going to be really expensive for anybody to buy a dell, really hard to pull off. but if it does, the private equity firms would go in and given a preemous for the stock price, 50% to 100% premium. for shareholders, it would be a win. for michael dell it would be a win because it would allow him to be more creative. this could be michael dell's born-again moment. he said he wouldn't have to answer to shareholders anymore. he could establish maybe an allian alliance with apple. another way to go about this is you can fix the company behind the scenes, make it more profitable, make it grow more and take it public again. of course, it's all speculation. it's very interesting. >> so many fast changes in the tech world. >> i do have two dells. but they're sitting in the corner collecting duftz. >> that's right. they're coasters right now. 27 minutes after the hour right

for you a little later. welcome back to "early start," everyone. i'm john berman. >> and i'm zoraida sambolin. it is tuesday morning. 31 minutes past the hour. he's denied any use of using performance-enhancing drugs. now lance arm strong has just done that. the confession came during a 2 1/2-hour interview with oprah winfrey, which will be broadcast thursday on her own network. cnn's ed lavandera is live in texas this morning. a lot of people are wondering if this is a genuine confession, or is it part of a larger p.r. offensive? >> reporter: well, i think people will be looking and studying the body language taped interview and determine just that. it will go a lock way in determining how you feel about that. but, you know, clearly there's a need to rehabilitate his image thereafter united states

anti-doping agency report that was released back in october. 11 former teammates coming out and basically accusing lance armstrong of using performance-enhancing drugs throughout his cycling career which helped him win seven tour de france titles, but that interview took place in austin yesterday afternoon. oprah winfrey sent out a tweet that said briefly, just wrapped with lance armstrong for 2 1/2 hours. came ready. he's well known for being a tough interview, well prepared. according to a source from cnn, lance armstrong showed up with a team of advisers and family members. >> and lawyers as well. that "ready" in capital letters. we also know he apologized to the livestrong organization. i think most people would agree they'd like to see livestrong survive. what did he say to those people? >> reporter: well, you know, this is an agency that has been

intertwined with lance armstrong as well and they triering to separate themselves. lance armstrong was separated out before the report came out. before he went for the interview with oprah he stopped by the headquarters and had about a 15-minute meeting, i'm told, with the staff there where he apologized to them for all the stress he had caused them over the years and also urged them to continue their fight. a spokeswoman for if foundation said -- described the meeting as it was emotional and he choked up for a moment, but we were all glad to see him. >> it's got to be very tough for all of them to fight closely to fight cancer. we're also following reports that armstrong may give back some of his sponsorship money. do you know anything about that? >> reporter: a source tells cnn that right now lance armstrong is in talks with the united states postal service to return a portion of the $30 million that the agency spent sponsoring

the cycling team. the statement from the u.s. post at service, we got one last night said we are well aware of the developments surrounding lance armstrong and are following the situation closely. we're not in a position now to discuss any of the legal issues associated with these developments and the prior relationship between the u.s. postal service and mr. armstrong, but we will do so at an appropriate time. we'll have to wait and see as well. >> ed lavandera, austin, texas. thank you very much. vice president joe biden's task force is recommending that gun trafficking be defined as a federal crime. according to politico, the white house has defined 19 executive actions where the president may act unilaterally. others are mulling these executive orders because of the difficulty in enacting new gun legislation in congress.

president obama is expected to lay out his proposals formally next week. the house is expected to debate on the second part of the disaster from superstorm sandy. lawmakers have been pushed for the $51 billion relief measure and conservative republicans have complained the price tag is too high and including spending that has nothing to do with the storm. twisted metal and wrecked carriages. this was a scene in egypt overnight as a train derailed. railway officials say at least 19 people were killed, more than 100 people were injured. about 150,000 children in new york city will have to find another way to get to school tomorrow? why? school bus drivers say they're going on strike. the union says it wants to protect the drivers' jobs. skood bus drivers are up for bid for the first time in 33 years. an update on the political soap opera that is south carolina. former south carolina first lady

harangued them saying, wait a second, you're selling this product that might be contributing to obesity. they're trying to say, look, we're aware of this problem and we're doing our part. for example they point out we're selling smaller sizes of coke, 7.5 ounces instead of 12. they say we have nearly 200 lee-calorie and no-calorie products. they also say we're starting to put our calories, you can see it right here on the silver band, 140 calories so you know what you're getting. so they say that they're really trying to help people make choices. they're encouraging exercise and they really hopes this sort of quiets down some of their critics. >> we've been talking about america's obesity problems for years and years. and soda, consumption, i believe, has been going downer of the the last several years f my question is then how responsible is soda really? >> if you look at this, as i said, a can of coke is 140 calories. let's say you have two of these

a day. that's more than 10% of the calories you're getting for a whole day just in soda. if you look at the sugar consumption, that spells it out. there are approximately 9 tea spoons of sugar in one can of soda. that's a lot of sugar. and according to many experts. when you drink your sugar it actually gets into your bloodstream faster than when you're eating it because when you're eating it, for example when you eat an apple, there's fiber being digested along with it. it doesn't go into your bloodstream quite as quickly. i'm not a soda drinker but when i watch my friends who drink soda, they can easily drink three of these in a day. that's a lot of calories, a big chunk of calories devoted to something that doesn't have any nutrients in it. >> that's really interesting. know e that to be the case but when you lay it out on the table, all that sugar, it really

be leaning towards the tough talk we have been hearing. the nbc news "washington post" poll showing that 88% of americans support background checks for gun show sales and 11% oppose it. when it comes to support for the sale of ammunition, 76% said they support it and 22% oppose it. we heard about the federal database to track gun sales. 71% of those polls support this. 27% oppose it. finally the nra, something they have been pushing for sometime since that shooting, there should be armed guards in every school. 55% of the people support it and 42% oppose it. there is strong, strong support for some action in order to prevent violence in these mass shootings. >> the poll numbers show support

options. they are emphasizing that they are making smaller sizes of some of their drinks. 7.5 ounce rather than the 12 ounce and also that they are putting the calories out there on the front. it says 140 calories and saying we are not just fighting it, we are putting it out there how many calories our products have. >> we're have been talking about america's obesity epidemic for years. you have this wonderful display earlier. it seems like sugar is the problem. >> sugar which of course adds up to calories. according to the school of public health, sodas have about nine teaspoons of sugar in one soda. you are getting all of that when you drink i can of soda. when you add the calories up, a lot of people drink more than one can and that's 280.
